MINEOLA, N.Y. – Nassau County District Attorney Madeline Singas announced that a South Floral Park man was sentenced today to a combined 20 years to life in prison and five years’ post-release supervision for his role in a broad daylight murder and attempted murder that occurred in Hempstead in October 2018.
Brian Marshall-Gibson, 25, pleaded guilty on April 29 before Judge Robert Schwartz to charges of murder in the second degree (an A-I felony), attempted murder in the second degree (a B violent felony) and criminal possession of a weapon in the second degree (a C violent felony).
“A young man is dead because of a senseless act of gun violence to settle a score,” DA Singas said. “We hope this sentence helps the family and friends of Demetrius Winfield in the grieving process as they continue to mourn his tragic loss.”
DA Singas said that on October 19, 2018, at approximately 10:54 a.m., victim Demetrius Winfield, was with a friend, a local cab driver on break, in front of a home on Wellesley Street in Hempstead. Winfield and his friend were then allegedly shot by Jamik Cannon and Brian Marshall-Gibson.
Winfield was shot in the face, chest and groin and was pronounced dead shortly afterward at Winthrop Hospital. The second man was shot in the leg and is recovering.
Cannon and Winfield were known to each other and had gotten into a disagreement several days earlier at a gas station.
They were arrested by members of the Nassau County Police Department on December 11, 2018.
The case against Jamik Cannon is pending.
Senior Litigation Counsel Michelle Lewisohn of DA Singas’ Major Offense Bureau and Assistant District Attorney Paula Cajdler of the County Court Trial Bureau are prosecuting this case. Marshall-Gibson is represented by Dana Grossblatt, Esq. and Cannon is represented by Dennis Lemke, Esq.
The charges are merely accusations and the defendants are presumed innocent until and unless found guilty.
